AI Discrimination, Transparency Bills Introduced in Washington and Virginia

Legislation that would establish state-enforced civil penalties for AI-related violations was prefiled in Washington and Virginia this week.

Washington State Rep. Clyde Shavers (D) introduced HB-1168, which would require that developers share detailed information about data they use to train AI systems, allowing consumers to better understand AI decision-making. The state attorney general would have sole enforcement authority.

In Virginia, Del. Michelle Maldonado (D) prefiled HB-2094, which would establish AG-enforced civil penalties for algorithmic discrimination and harm created by “consequential decisions” that AI systems make. The bill would become effective in July 2026.
