Va. AI Bills Pass Originating Chambers

Virginia legislators approved multiple AI measures on Tuesday that cover private and public use of high-risk systems.

The House narrowly voted 51-47 for HB-2094 by Del. Michelle Maldonado (D). It would establish AG-enforced civil penalties for algorithmic discrimination and harm created by “consequential decisions” that high-risk AI systems make. The bill would become effective in July 2026 (see 2501270030).

With the vote tally, the House passed HB-2046, covering government use of high-risk AI systems. In addition, that day, the Senate voted 40-0 to approve the similar SB-1214.

“The level to which agencies use these AI systems will vary from agency to agency, but it can be assumed that any agency who does use these systems will have additional administrative duties to meet the requirements of this bill,” said a fiscal impact summary of SB-1214. “Additional personnel with a background in complex AI systems may be needed to fulfill the bill’s requirements. The cost of these personnel is indeterminate at this time.”
