Miss. House Supports Rebuttable Presumption for Government Data Breaches
The Mississippi House voted 104-12 on Thursday to pass a bill related to liability for data breaches. It goes next to the Senate.

State and local governments wouldn’t be liable for cybersecurity incidents if they adopt standards that safeguard data, says HB-1380. The legislation would create a rebuttable presumption for governments and third-party agents contracted to maintain, store or process personal information. They wouldn’t be “liable in connection with a cybersecurity incident if the covered entity or third-party agent, in good faith, substantially complies with reasonable measures to protect and secure data in electronic form containing personal information and has” adopted certain cybersecurity standards, including the National Institute of Standards and Technology framework, the bill says.
