Court Approves Mont. AG, TikTok’s Joint Stay in Lawsuit
The U.S. District Court of Montana ordered a stay of proceedings in a case about the state’s attempt at banning TikTok Wednesday, after the parties jointly moved for the motion.

"Proceedings in this case shall be stayed pending the President’s determination,” Judge Donald Molloy said. “The stay will be lifted if this Court’s preliminary injunction order is reversed by the United States Court of Appeals for the Ninth Circuit.”
Case 23-00061 started in May 2023, when plaintiff TikTok filed a complaint against Montana attorney general Austin Knudsen for attempting to ban the social media platform. The parties jointly filed a motion to stay proceedings on Feb. 6, so that President Donald Trump and his administration can determine the right course of action on TikTok, reflected by his Jan. 20 executive order concerning the social media platform.
