The committee rejected a proposed amendment by Sen. Phil Fortunato (R) that would have removed the bill’s private right of action, among other changes. Fortunato opposed the bill as written because he didn’t think companies could comply and since similar measures from other states face court challenges. Ranking Member Perry Dozier (R) agreed, saying Washington should wait for the 9th U.S. Circuit Court to rule on such bills.

The House Consumer Protection Committee is scheduled to vote on a similar bill (HB-1834) on Friday. That committee heard testimony Tuesday (see 2502190017). Officials from Washington’s governor and attorney general offices supported the Senate version at a hearing last week (see 2502130052).
