Businesses Should Invest in Privacy By Design, Says Proskauer
The new year has brought “escalating state regulatory demands and stricter enforcement reshaping business practices,” Proskauer privacy lawyers blogged Monday.

“Companies must embed privacy into their core operations,” the attorneys said. “By investing in privacy-by-design frameworks, adaptive compliance systems, and monitoring of emerging risks, businesses can stay ahead of shifting regulations.”
Expect “heightened scrutiny” on algorithmic transparency and biometric privacy in 2025, the lawyers said. “While compliance challenges and rising operational costs are likely, organizations that proactively audit data-sharing practices, update privacy policies, and ensure AI compliance will be equipped to navigate the evolving regulatory landscape and reduce overall legal risks.”
A national consumer privacy law remains unlikely “for the foreseeable future,” the Proskauer lawyers said. “In the absence of clear federal guidance, businesses should expect to rely on recognized industry standards in the interim.”
