President Donald Trump on Tuesday fired Bedoya and fellow Democratic Commissioner Rebecca Kelly Slaughter (see 2503190046). Bedoya told the Organized Money podcast he will file a lawsuit, and he hopes to get back to work on the commission soon.

Any 2-0 decisions the Republican majority makes on FTC enforcement, rules and policy will be “illegitimate” because they are denying two Senate-confirmed Democrats the right to vote, he said.

Bedoya noted the FTC Act states commissioners can only be removed by the president for specific causes: “inefficiency, neglect or malfeasance,” as written in the statute. The U.S. Supreme Court ratified this and the need for independent, bipartisan commissions in its unanimous Humphrey’s Executor decision (see 2502200060), he said.
