Dozens of AGs Join Call for 23andMe Privacy Ombudsman

Dozens of states urged a federal court to appoint a consumer privacy ombudsman to oversee data protection issues in 23andMe’s bankruptcy sale (see 2504100046). Florida, New York, California and Utah were among states seeking an ombudsman.

23andMe earlier asked the U.S. Bankruptcy Court for the Eastern District of Missouri to allow the company to appoint its own “customer data representative.”

A coalition of National Association of Attorneys General members and AGs from Missouri, California and Alaska submitted separate filings in support of a court-appointed ombudsman. Texas and DOJ’s Office of the U.S. Trustee have also requested an ombudsman.

The NAAG coalition recommended the “careful selection of an independent, proactive, and knowledgeable ombudsman for this extraordinary case. A standard pro forma analysis with a boilerplate report will not suffice with this unique data set and its far-reaching impact.”
