Ark. AG Appeals Social Media Law Injunction to 8th Circuit

Following Monday's brief asking a district court to alter or amend its ruling that permanently enjoined Arkansas' social media safety act, Tim Griffin (R), the state's attorney general, filed a notice of appeal in case 23-05105 to the 8th U.S. Circuit Court of Appeals.

The AG previously asked the U.S. District Court for Western Arkansas to change its ruling enjoining the law (see 2504010044) on the grounds that the court lacks authority to abolish a law, only block enforcement of it (see 2504290036).

Griffin filed the appeal "out of an abundance of caution," giving the district court time to amend its March ruling in Griffin v. NetChoice, LLC, said the court document. District Judge Timothy Brooks ruled the 2023 Arkansas law burdened access to constitutionally protected speech and gave the algorithm more access to age data in his decision.
