AG Privacy Consortium an ‘Important’ Development, Says Safeguard Privacy Counsel

No matter how aggressively the FTC under the Trump administration pursues privacy cases, state attorneys general are clearly ready to band together and enforce state laws, Safeguard Privacy General Counsel Andy Hepburn said Wednesday at the Privacy + Security Forum.

It was an "important" development when the California Privacy Protection Agency and AGs from California, Colorado, Connecticut, Delaware, Indiana, New Jersey and Oregon launched the Consortium of Privacy Regulators in April (see 2504160037), said Hepburn. It shows the states “are not going to wait for the FTC to enforce their laws.”

The prior FTC showed a willingness to enforce cases beyond “marquee” companies like Meta, Google and X, noted Hepburn, citing the agency’s January settlements with Gravy Analytics and MobileWalla (see 2501140072). FTC Chairman Andrew Ferguson, then a commissioner, voted in favor of the settlements.
