House-Passed Reconciliation Package Includes AI Moratorium Provision

The House passed its reconciliation package with a proposed 10-year AI moratorium on a 215-214 vote Thursday (see 2505210065).

The One Big Beautiful Bill Act (HR-1) now heads to the Senate, which returns to Washington June 2. Some have speculated on whether the moratorium, which would block states from enforcing certain AI laws, might be disqualified from consideration under the Byrd Rule, which limits the reconciliation process to budget-related provisions.

Two Republicans voted against HR-1 in the House: Thomas Massie of Kentucky and Warren Davidson of Ohio.

There’s potential Republican opposition against the AI proposal in the Senate. Sen. Marsha Blackburn, R-Tenn., at a hearing with Senate Judiciary Committee members Wednesday, said AI protections are needed to secure intellectual property rights in Tennessee: “We need those protections, and until we pass something that is federally preemptive, we can't call for a moratorium on those things.”
