NY Senate Passes AI Bill with Private Right of Action

The New York Senate voted in support of a bill regulating high-risk AI with enforcement from the attorney general and through a private right of action.

S-1169 by Internet Committee Chair Kristen Gonzalez (D) seeks to regulate “the development and use of certain artificial intelligence systems to prevent algorithmic discrimination [and] requires independent audits of high risk AI systems,” said a sponsor memo on the bill.

“It is the duty of government to protect citizens and hold developers and deployers accountable for irresponsible practices and harm caused through errors of their systems,” the memo said. “This bill creates a framework that is designed to address risks before they become harmful to citizens. Under this bill, if such harm occurs or an entity fails to proactively address risk, they may face liability.”
