Latvian DPA: AI-Generated Images Don't Necessarily Involve Personal Data Processing

Using an AI-created image doesn't necessarily involve personal data processing, the Latvian data protection authority said Thursday.

Such images are artificially created and don't include actual people. So, from a privacy and data-protection perspective, they're a reliable solution for illustration purposes, the DPA said.

However, when an AI-generated image is created using a particular person or their visual characteristics, and it's subsequently associated with an identifiable individual, the creation and publication of the image may be deemed personal data processing, the regulator added.

As such, it advised using AI-generated content in situations where it's necessary to illustrate something without risking violations of someone's rights.

It stressed that the DPA lacks jurisdiction to evaluate certain cases, such as images of children or adults involved in accidents.
