Lawyers Expect Challenges to Social Media Warning Label Requirements

State requirements to display social media warning labels will likely be challenged before they take effect, said Liisa Thomas and other SheppardMullin privacy attorneys Friday.

Minnesota signed the first such requirement into law last month and other states, including California and New York, are considering similar measures (see 2506180004). The bills would require platforms to display warnings that social media could be dangerous to one’s mental health.

“Unless challenged,” blogged the lawyers, the Minnesota law takes effect July 1, 2026. The state’s health commissioner must write guidelines by March 1 that year. “While we anticipate that these social media label requirements will be challenged prior to the 2026 effective dates, they demonstrate ongoing concern from US state law makers over the impact of social media use.”

California’s Senate Health Committee has a hearing scheduled next Wednesday on a warning-labels bill (AB-56). New York’s measure passed the legislature last month but still needs a signature from Gov. Kathy Hochul (D).
