New York AG Stays Enforcement of New Surveillance Pricing Law

New York Attorney General Letitia James (D) won’t enforce a new surveillance pricing law until a federal court rules on the National Retail Federation’s lawsuit seeking a preliminary injunction, the AG’s office said in a letter Monday.

NRF on July 2 sued to block the Algorithmic Pricing Disclosure Act, which had a July 8 effective date. The law requires companies using algorithmic pricing to publicly disclose to consumers when they’re using their personal data to set prices. The trade association argued the new disclosure requirements are “misleading and ominous.”

The AG’s office said it will stay enforcement until 30 days after the U.S. District Court for the Southern District of New York (docket 1:2025cv05500) issues a final order.
