Case 23-02431 was partially dismissed last month, when Judge Vince Chhabria ruled that updates on Google's help pages about blocking PHI proved the tech giant wasn't intentionally obtaining the data (see 2506060045).

However, he allowed parts of the case to continue, including claims under the Wiretap Act, the California Invasion of Privacy Act (CIPA), intrusion upon seclusion, and common law privacy for communications prior to the 2023 updates.

An amended complaint was filed in the U.S. District Court for Northern California later in June.
